Digital Sommelier Terms and Conditions

Welcome to the Digital Sommelier Mini App (“the App”). By accessing or using the App within Shopify Shop Minis, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the App.

1. Purpose of the App

The App provides automated, general-purpose wine suggestions based on optional user inputs.

The App does not:

  • Provide professional or certified sommelier advice

  • Guarantee correctness, suitability, or relevance of any recommendation

  • Guarantee product availability, pricing, or quality

  • Influence or validate merchant content or products

Use of the App is entirely voluntary and at the user’s own discretion.

2. No Warranty — Service Provided “As Is”

The App is provided strictly on an “as-is” and “as-available” basis, without warranties of any kind, express or implied, including but not limited to:

  • Accuracy

  • Reliability

  • Merchant product suitability

  • Fitness for a particular purpose

  • Non-infringement

  • Availability or uptime

We make no assurances that the App will operate without interruption, errors, defects, or security issues.

3. No Liability

To the fullest extent permitted by law:

  • VN Studios

  • The developers

  • Contributors

  • Contractors

  • Affiliates

Assume zero liability for any damages, claims, or losses arising from or related to:

  • Use or inability to use the App

  • Any wine recommendations

  • Purchases made based on App suggestions

  • Errors, inaccuracies, or omissions in the App

  • Merchant product pages, listings, descriptions, or pricing

  • App outages, bugs, interruptions, or unexpected behavior

  • Any alcohol consumption decisions

  • Compliance with local alcohol laws

This includes, but is not limited to, direct, indirect, incidental, consequential, special, punitive, or exemplary damages, even if advised of their possibility.

By using the App, you agree to fully release and hold harmless VN Studios and all related parties from any liability or claims.

4. No Personal Data Collected

The App does not collect, store, or process personal information.

  • No analytics

  • No tracking

  • No persistent identifiers

  • No data shared with VN Studios, third parties, or merchants

All inputs used to generate recommendations are processed ephemerally and discarded immediately.

5. No Association or Endorsement

The App has no affiliation, sponsorship, or endorsement with any of the following:

  • Wineries or wine brands

  • Alcohol producers or distributors

  • Retailers, merchants, or Shopify stores

  • Shopify as a company

  • VN Studios or its clients

Any product data (if shown) originates exclusively from merchant listings on Shopify and is not curated or validated by the App.

6. Alcohol Consumption Responsibility

By using the App, you confirm that:

  • You are of legal drinking age in your jurisdiction

  • You are responsible for your own alcohol-related choices

  • You understand the App’s suggestions are purely informational and not professional advice

The App does not promote excessive or irresponsible drinking.

7. User Responsibilities

You agree that you are solely responsible for:

  • Any purchases or actions based on recommendations

  • Ensuring compliance with local laws regarding alcohol

  • Verifying product details directly on merchant pages

  • Using the App in a lawful and responsible manner

If you do not meet these requirements, you must stop using the App immediately.

8. Intellectual Property

All code, features, logic, and design elements of the App are owned by the developer and are protected by applicable intellectual property laws.

Users are granted a non-exclusive, revocable, limited license to access the App solely for personal use within Shopify Minis.

No rights are granted to copy, reverse engineer, reproduce, or redistribute any part of the App.

9. Termination

We may suspend or terminate access to the App at any time, without prior notice, for any reason, including maintenance, updates, removal of the app, or violations of these Terms.

10. Changes to the Terms

We may modify or update these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of New York, USA, without regard to conflict of law principles.

Any disputes arising from the App must be resolved in the courts of the above jurisdiction.
